Disposition of your item if it does not sell:

• If any of your items do not sell after 7 days,we will NOT Relist them. We will contact you & you will need to pick them up at one of our locations within 7 days. This may or may not be the same location your dropped them off at.

• If any of your items do not sell, you must either pick them up within 7 days, or have us donate them to charity. Any of your items not picked up before the end of the 7 days will be donated to charity, disposed of or resold without any further authorization from you.

• At the end of the auction we will notify you that your item did not sell via telephone, email or standard US mail.

NOTE: The terms of the online auction will be governed by eBay¦s applicable terms and conditions. The actual sales price will be the highest qualified bid received, subject to receipt of actual payment from the buyer. We do not control the sales price, which may be less than could be obtained through alternative means. The buyer has 3 days to contact us in order to return the item and receive a refund, but ONLY if the item does not match the description. For example, if your listing says an item is in working condition and it is not, the buyer can return it. As long as you disclose everything about the item, it is unlikely that the buyer will return it. However, we (and you) must wait for the return period to end before we settle with you. The entire process from listing your item until you receive your settlement could be 30 days.

Agreement:

This Agreement describes the terms under which Quik2Sell ("we") will list your items for auction on eBay® for you. This agreement is between Quik2Sell (the "consignee") and you (the "consignor") This is a legal document, so please read carefully before signing.

Here's how our service works:

We will list your item on eBay auctions for a 7-day listing including a gallery picture and description. The opening bid is set between .99 Cents - $9.99, solely at our discretion. There is no minimum bid or reserve price, and your item could sell for any amount.

When the auction is complete, we will collect the money from the buyer. We will then ship your items. Once the return period is over (where buyer is allowed to contact us within 3 days of delivery & return the item if it was not as listed), we will mail you a check for the gross selling amount, less our commission, eBay's listing and final value commission fees & a 3% payment processing fee. Shipping and handling will be paid by the buyer to us, and we will package & ship your item.

Our commission:

We charge a commission for auctioning your item on eBay. Our commission is as follows:

25% of the first $500.00
20% of the next $500.00
15% of any amount over $1,000.00

Quik2Sell Commission fee, eBay Listing & Final Auction Value fees & a 3% payment processing fee are deducted from your check. Buyers pay all shipping, handling and insurance costs. Payment will be made to you by check via US Mail only after the auction transaction is completed. This could be 30 days or longer, although typically it may only be as long as 21 days. Auctions take seven days. Payment, shipping and approval could take as many as 30 days. Once the approval period is over, we will promptly send you a check for sale price minus the eBay fees & Quik2Sell commission fee stated above.

THE SERVICES PERFORMED AND PRODUCTS PROVIDED UNDER THIS AGREEMENT ARE PROVIDED "AS IS" AND WITHOUT WARRANTY, EXPRESS, IMPLIED OR STATUTORY. Quik2Sell SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Quik2Sell IS NOT LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES THAT MAY ARISE FROM OR IN CONNECTION WITH THIS AGREEMENT, THEIR PERFORMANCE OF THIS AGREEMENT OR THE SALE OF YOUR ITEM. IN NO CASE WILL Quik2Sell BE LIABLE FOR ACTUAL DAMAGES IN EXCESS OF THE SELLING PRICE OF YOUR ITEMS, LESS OUR COMMISSION AND FEES.

THIS IS THE COMPLETE AGREEMENT OF THE PARTIES. THERE ARE NO ORAL TERMS. THIS AGREEMENT IS NOT ASSIGNABLE BY YOU.
